Definition of Illegal Harassment
Illegal harassment means unwelcome sexual advances; requests for sexual favors and other verbal or physical conduct relating to a person’s sex, race, color, national origin, age, religion, height, weight, marital status, disability, or sexual orientation when:
1. Submission to the conduct is made an explicit or implicit condition of employment;
2. Submission to or rejection of the conduct is used as the basis for an employment decision; or
3. The conduct substantially interferes with an employee’s work performance; creates an intimidating, hostile or offensive work environment; or otherwise adversely affects employment opportunities; or
4. In the case of conduct directed toward students, is so severe, pervasive and objectively offensive that it effectively bars the student’s access to an educational opportunity or benefit.
Any person who believes that she or he has suffered harassment must report the incident(s) to the building principal or to the assistant superintendent of human resources, 956-2023, or to the assistant superintendent of business services, 956-2007. Any building principal who receives a report of harassment (whether from a student or other person) must report the incident(s) to the assistant superintendent of human resources or the assistant superintendent of business services.
Reports of harassment will be investigated and appropriate remedial action will be taken. No person who reports harassment will suffer any form of reprisal or retaliation by the district, provided the report is not false. Harassment reports and investigations will remain confidential to the extent permitted by law and the sound administration of the district.
The district considers harassment on the basis of sex, religion, race, color, national origin, age, height, weight, marital status, disability, or sexual orientation (or retaliation for making a report of such harassment) a major offense which will result in disciplinary action against the offender, regardless of his or her position or status with the district.
